When Lawyers Go Bad: Law Library Book Thieves: Law and Ethics

The Law Librarian, the Washington County Bar Association, the Law Library Committee, and the Oregon State Bar consider it a serious matter when attorneys do not return borrowed Law Library materials. Please note OSB Rule of Professional Conduct 8.4(a) & ORS 164.005, 164.015, 357.975 & 357.990

After watching so many resources fly out of our library, I started wondering if attorneys considered the library a professional perk (snag a resource a week) until I caught a non-lawyer walk out with three books. I followed her down the street for a ways until she turned to me and asked if I was going to follow her to the courthouse. I said yes and that when we get there I would have the police arrest her for theft of library materials. She threw the books at me and stomped away. I have not seen her since.

Thank you for the excellent story! We had our own Book Thief Chase, across the street to the Courthouse, but it didn’t turn out as well. Luckily it was “only” a statute volume that was soon to be replaced and recycled. But it still cheesed us off. I prefer the satisfactory ending you had. I’ve often wanted to ask Courthouse Security to check if any books brought into the courthouse had Law Library stamps.

Two years ago our undergraduate library had a book thief who stole over $130K worth of books. He made his way to the law library and in under two weeks took $7K worth of books. He was caught by the local police department stealing books from the undergraduate library and I worked with the police and we recovered most of the materials ($115K of the undergraduate library books and $6K of my library books). He was a former undergraduate student who was a professional book thief who resold them on the Internet. He was convicted of several felonies and subsequently deported.
