If you’re a member of an association of owners (aka HOA) and want to learn about how the Oregon Legislature makes laws, here are two bills just for you. You can track them on the Legislature’s website – no need to drive to Salem, unless you want to. And contact your State Legislator to ask about these bills. A Find Your Legislator” search tool is on the Legislature’s home page.

HB 2582: Prohibits association of owners for, or declarant of, planned community or condominium from prohibiting display of signs based on content of sign.

HB 2584: Prohibits association of owners for, or declarant of, planned community or condominium from making records of association confidential or exempt from disclosure to owners of real property in planned community or condominium.

The news that AirBnB plans to set up shop (NA headquarters?) in Portland, Oregon (and that cheers have gone up from people who previously had been wringing their hands about AirBnB) has us scratching our heads. Not that we don’t adore living in Portland, cheer on small businesses, embrace bartering, face the challenge of making ends meet, and all that, but ….

Portland, and lots of other cities, have been wrestling, quite publicly, with the AirBnB business model, which puts customer convenience and cost priorities at odds with local safety and zoning priorities, not to mention tax revenues from locally licensed hotels and traditional B&Bs.

We might blog more about this topic, or we might not since it’s clear there is no shortage of news, hand-wringing, and economic analysis in print and cyberspace on the subject, but I did just see this article at the ABA website. So, if you’ve missed out on the conversation – or are wondering when it’s time for the lawyers and politicians (and lobbyists) to start their engines, take a moment to read:

  • Ecovillages
  • Cohousing
  • Local investing
  • Car sharing
  • Urban agriculture
  • Cottage-scale industries

The  two-day workshop will address legal questions that arise in efforts to build more sustainable economies, including those relating to entity formation and structure, securities laws, employment laws, tax laws, real estate law, zoning laws, risk management, and regulation of commercial activity.

Oregon is a common law property state, so what happens when you move here from a community property state and you want to preserve your community property rights?

If you are a community property couple and you move to Oregon, you need to be careful how you buy property, how you title it, how you finance it, how you dispose of it, etc., etc., etc.

The January 2008 issue of the OSB Estate Planning and Administration Section newsletter has an article on the subject, Preserving Community Property Rights in Oregon, by Kevin Tillson, Hunt & Associates, PC.
