I enjoyed this Oregonian story, not just because there are law library users amongst the parties, or because it takes place in this very interesting and creative place named Hillsboro, Oregon, but most of all because it is very funny. Don’t we all love the book or the movie where the little guy manages to win, despite the odds, through sheer stubbornness and persistence, not to mention smarts?

In this instance, it seems there were quite a few winners, and quite a few laughs – and even a peacock, about which I too know a little.

In the late 70’s through 1980’s Oregon county counsel attorneys prepared formal opinions on significant issues, sort of like Oregon Attorney General opinions. These opinions were open to the public, but used infrequently because many were soon out of date and potentially misleading to those who didn’t work with these sorts of documents on a regular basis.

If you need a particular county counsel opinion, ask a staff member in your county counsel’s office. They may have a list or an index of their opinions.

These “formal” opinions are different from other written memos, analysis, etc. that county counsel attorneys write. The latter are generally covered by the attorney-client privilege unless the client waives it. In most cases the client does use it publicly and waives – but that is determined on a case by case basis.

Cutting public sector budgets is a complex enterprise. Sometime cutting $$ out of a budget means cutting 2, 3, or 20 times the original $$ cut, e.g. when you cut a budget item and lose the matching funds or when you cut “officers of the state” positions (e.g. state police or state park rangers) and lose the revenue from licenses or law enforcement.

Sometimes it makes sense to spend money to make money, which can work in the public sector the same way this works in the private sector. For example:

Oregon has a variety of county, municipal, and justice courts. And now it has a new county justice court. Read the online Blue Book entry on justice court judges (or follow the OJD link). You can also read the state statutes on Justice Court: ORS, Chapter 51.010 et seq.

Metro’s RID Patrol tackles the problem of illegal dumping in multiple ways: cleaning up dump sites, investigating evidence found at the dump sites, issuing citations to the guilty parties, investigating haulers that are illegally dumping and working with communities that need education and help to reduce dumping in their neighborhood.

If you drive in Portland, you need to know about the Bike Boxes and the Law:
